Welcome to ibibo CricEx - the Game ("Game"/"Service") brought to you by ibibo Web Private Limited ("ibibo," "WE," "US," OR "OUR", "ibibo.com").
1. This Game is open to Indian citizens residing in Territory of Union of India, until discontinued by ibibo.com. Directors, Officers, Service Providers and Employees of ibibo.com; its affiliates, subsidiaries, vendors, consultants and their employees and their direct relatives are not eligible to receive prizes awarded for winning the Game.
2.The Term of this Game is from 8th October 2009 to 23rd February 2010 ("term").
3.These terms of use are legal and binding on you to access and enjoy the Game. By accessing the Game, you are indicating that you have read these Terms of Use, that you understand it, and that you consent to be bound by all of its terms and conditions, including terms as may be amended by ibibo, in its discretion, from time to time. You should regularly review the Terms. In the event the modified Terms are not acceptable to you, you should discontinue using the Service. However, if you continue to use the Service you agree to accept and abide by the modified Terms.
4.These Terms of Use sets forth your rights and obligations with respect to your use of the Game. If at any time you do not agree to the Terms of Use, you are not authorized to use and access the Game and will disqualify you forthwith from participation or winning as the case may be.
5.You represent and warrant that you are competent and eligible to enter into legally binding agreement. Further, You will continue to be governed by the terms and condition of the website http://info.ibibo.com/terms.html
6. ibibo.com reserves the absolute right to disqualify you if it considers that you have used improper means to participate in the Game or have in any manner breached the terms of use herein or terms of the site.
7.To avail of and use the Services and play the Game you will have to register with ibibo.com. As a part of registration process you agree to provide ibibo.com with current, complete, and accurate registration information (the “Registration Data”) and keep it updated, complete and accurate. If ibibo.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, ibibo.com retains the right to indefinitely suspend or terminate your membership and refuse to provide you with access to the Service.
8.This Game is a virtual trading game where you buy and sell virtual shares ("shares")of your favourite cricket players ("Players"), without any signup fees. You can create your portfolio of Players and if the Players selected by you perform well, you can get to feature on the leader board and win the following prizes, as per the set criteria decided by the Company in its sole discretion("Winners"):
1st prize - Rs. 25,000/-
2nd prize - Rs. 10,000/-
3rd prize - Rs. 5000/-
1st prize - Rs. 25,000/-
2nd prize - Rs. 10,000/-
3rd prize - Rs. 5000/-
9. The aim of the game is to increase your net worth and profit by buying and selling shares of Players. You agree that the Company may, in its sole discretion reset your portfolio at anytime keeping in mind the requirement of the Game.
10. You can buy as many shares of Players as you wish, but the total value of the shares you buy for each of the Players cannot exceed your cash in hand. Like the stock market it is up to you to invest in shares of many Players or of just one Player.
11.A notional account is created in your name and details of shares of Players held by you, profit/loss as may be applicable in your account may be accessible to other users. Profit/Loss incurred by You is on buying/selling using virtual money hence You will not be entitled to any monetary payout under any circumstances whatsoever. The Player's performance in the match currently live determines the change in price. A Player performing well will cause the share price to move upwards and bad performance will cause the price to decrease.
12. You agree that this game is based on virtual money, which cannot be converted to real money. You agree that by participating in this Game you do not own any Player or get connected with him in any manner whatsoever. The Game may not be used in connection with any form of gambling. We run this game purely for the purpose of testing cricket skill and knowledge. The Players are not endorsing the Company or the Game in any manner whatsoever.
13. The Winners of the Game will be announced within 2 weeks from end of the term.
14. ibibo shall not entertain any questions, enquiries on the manner of conduct of the winner declaration and the Game itself from any party whatsoever.
15. ibibo reserves the right to request for a valid identification or other document from You. The Winner(s) will be required to submit documentation such as ID, age proof etc. as required by us within 5 days from release of the winner's name.
16. If the required documentation is not submitted by the Winner within 5 days from release of his/her name, we reserve the right to select an alternative winner(s) and the original winner's entitlement to the prize will lapse.
17. The prizes shall be delivered to the Winner(s) only on receipt and verification of the required documents. The prizes will be delivered to the winner(s) at the address provided by them within 7 days from receipt of required information by us.
18. The prizes cannot be transferred or exchanged for any other offer.
19. We shall not be liable for any damage caused to the prize during delivery or if the prize is lost in transit.
20. We reserve the right to change the prize due to circumstances beyond its control or to offer an alternative prize of similar value.
21. You agree and undertake that you shall not post/upload any content that is in violation of the terms of the site.
22. You agree and undertake that you shall not use this site/Game for any purpose that is unlawful or prohibited. This service is provided to you as a matter of convenience for your personal and non-commercial use and in no way promises any material return.
23. You agree and acknowledge that ibibo.com (including its directors, employees, affiliates, agents, representatives or service providers) shall not be liable for any loss, damage or liability resulting, directly or indirectly, from delays, interruptions, downtime due to electronic or mechanical equipment failures, telephone interconnect problems, defects, weather, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, or other like causes. ibibo.com shall have no liability to provide you access to the Game while interruption due to any such cause shall continue.
24. The Winners will be responsible for paying all tax(es) as payable under this Game. The Prizes will be handed over to the Winner(s) after deduction of TDS.
25. The Company reserves the right to amend the rules of the Game or alter the term or cancel or discontinue the Game or any part thereof without giving any reasons or prior notice.
26. No correspondence shall be entertained with regard to the Game.
27. The laws of India govern the Game. All disputes shall be subject to exclusive jurisdiction of Gurgaon courts only.
